industry. The agency said that all of the fatal injuries were preventable had the required safety measures been taken. Of the November 2021 incident, OSHA Area Director Ken Montgomery in Cincinnati is quoted as saying, “ The [Lanigan Construction LLC] owner and foreman

were onsite and allowed the pipelayer to work in hazardous conditions knowingly.” He added, “We cannot stress enough how important it is for employers to review and then implement required safety measures.” OSHA also cited the Lanigan Construction

LLC for failing to provide personal protective equipment such as hard hats, and for placing soil piles closer than two feet from the edge of the excavation, creating the hazard for soil falling back into the trench. “OSHA has a national emphasis program on trenching and excavations. Trenching

standards require protective systems on trenches deeper than five feet, and soil and other materials kept at least two feet from the edge of a trench. Additionally, trenches must be inspected by a knowledgeable person, be free of standing water and atmospheric hazards and have a safe means

of egress prior to allowing a worker to enter,” the press release goes on to share. The National Utility Contractors Association has declared June 2022 “Trench Safety Month.” OSHA will collaborate with the association for “Trench Safety Stand Down” week, June 20-24, 2022.

OSHA will also interview all pertinent people involved, as well as the supervisor of the area where the incident occurred, and other workers that have done the job that was being done by the victim.

Some of the important questions OSHA wants to get answers to include whether anyone has ever been injured doing the same job and with the same piece of equipment before; whether there were any near-

misses (where an injury could have happened, but didn’t); and if anyone had concerns about the job and/or piece of machinery and the environmental conditions, which were then raised with management prior to the incident.

The investigation is ongoing. Williams’ niece started a GoFundMe campaign for funeral expenses. She mentioned that the day Williams was killed in the incident, was his birthday. “This has been devas-

tating and very shocking to our family. Eric was the highlight of any occasion and knew how to enjoy life,” she said. The campaign has raised $2,780 of its $5,000 goal, as of this writing on March 8.

school officials that another student had a “bullet” in their possession. When the leadership team at the high school isolated the student, they secured a weapon in their search. “We are grateful to the quick action on all persons involved, especially to the high school leadership, Union Township Police and to the student reporting the incident,” Adams said. Adams said at the time of the incident, there was

no known verbal, written or physical threat toward any student or staff member. “While that is a small comfort, it did not and does not impact the seriousness with how we are handling the incident,” she said. She added that the District has “rigorous safety protocols in place,” and that the school administration routinely conducts roundtable exercises with local law enforcement to prepare for unexpected situations at school.

There are also regular school safety drills involving students and staff, and there is an open line of communication between the District and first responders. Adams also emphasized that everyone has a role to play in ensuring schools remain safe places to learn. “Please take time to remind your child that they should tell an adult if they hear about the possibility of a weapon at or near school or if they know about a student who

has a weapon. Saying something when you see something truly makes a difference—and it likely helped prevent today’s incident from escalating,” she said. Sergeant Ken Mullis, criminal investigations division supervisor with the Union Township Police Department, confirmed the story in a press release, noting that the school administration, upon receiving the tip from the other student, notified school resource officers with the Union

Township Police Department. The juvenile student allegedly in possession of a firearm and ammunition was charged with two felony offenses and one misdemeanor offense, according to Mullis. The juvenile is incarcerated at the Clermont County Juvenile Detention Center. Mullis said there were no known threats toward students or staff at the school. The investigation is ongoing.
