Dear Brand Representative: One of the keys to collective success is our partnership. As your partners, we are focusing more of our resources on delivering unparalleled service, developing innovative products, providing an unparalleled vehicle to create opportunity and developing a culture in which all parties are committed to the common good of the company, their communities, and the world. We also believe that this partnership requires that we all work towards achieving our common interests with integrity and business ethics. One challenge we continue to hear about from many of you is product diversion (e-commerce). Selling through unauthorized channels hurts all of us and we are increasing our focus and investment by aligning globally to more fully address the issue. One key is to take appropriate action if a Brand Affiliate is found to have breached his or her contract by selling products through unauthorized channels or by assisting in such sales. In egregious cases, affiliates engaged in, facilitating, or teaching product diversion practices to other affiliates will be terminated, or required to forfeit other privileges under their Brand Affiliate Agreement, regardless of title or tenure with the company. Moving forward – and based on these principles – Brand Representatives will have $150 in commissions withheld for each unit of unauthorized product sold in their first generation, $75 withheld for each unit of unauthorized product sold in their second generation, and $35 for each unit of unauthorized product sold in their third through sixth generations. The first occurrence will simply be a warning letter. The 2nd occurrence will apply these withholding amounts for each individual product up to $5,000 USD. The 3rd occurrence and beyond will apply the full amount of the withholding. Each situation will be carefully evaluated, and other sanctions may apply. This new upline withholding process will begin January 1, 2021. Thank you for your influence and leadership in training your teams on authorized sales channels.
