OVERVIEW This booklet is designed to assess your performance of competency as per the unit(s) outlined in the topic information section below. Your Trainer/Assessor or may assist you in ensuring that you have a full understanding of assessment requirements for this topic.

ASSESSMENT INFORMATION & SCOPE This assessment booklet covers the following unit/s of competency: 

CPCCBC4012B Read and interpret plans and specifications



CPCCBC4009B Apply legal requirements to building and construction projects



CPCCBC4003A Select and prepare a construction contract

All assessment tasks have been developed: 

to meet the requirements of the relevant Training Package; and



to be conducted in accordance with the principles of assessment and the rules of evidence; and



to meet workplace and, where relevant, regulatory requirements; and



in line with systematic validation.

Assessments have been developed to collect evidence that is in line with the principles of assessment and the rules of evidence and are: 

Validity (The assessor is assured that the learner has the skills, knowledge and attributes as described in the module or unit of competency and associated assessment requirements);



Sufficiency (The assessor is assured that the quality, quantity and relevance of the assessment evidence enables a judgement to be made of a learner’s competency);



Authenticity (The assessor is assured that the evidence presented for assessment is the learner’s own work)



Currency (The assessor is assured that the assessment evidence demonstrates current competency. This requires the assessment evidence to be from the present of the very recent past)

Demonstrating Competency To demonstrate competence, you must complete all assessment tasks to a satisfactory level in line with the above principles of assessment and the rules of evidence. Once all assessment tasks are completed to a satisfactory level your assessor will then deem you to be Competent for the specific unit. Reasonable Adjustment Inclusive practice is a key component used by Trainers/Assessors within each class, with Trainers/Assessors using a range of teaching strategies to meet individual needs and provide learning experiences that: take into account differing learning styles or preferences, recognise the differences among learners and ensure no one is excluded. Reasonable Adjustment is used, where appropriate, for assessment tasks within this course to ensure that all learners are given the same learning opportunities and the same opportunity to perform and complete assessments. Where Reasonable Adjustment of assessment tasks takes place within this course your Trainers/Assessor will clearly record on each assessment task how this has taken place. As part of this process any Reasonable Adjustment will ensure that the same level of knowledge and skills are demonstrated for all students as required by both the Unit of Competency and the Industry. Assessment/Re-assessment Requirements Where you are unable to demonstrate the required level of knowledge and skills through an assessment task you will have the opportunity to either re-attempt the entire original assessment task, add information to the original assessment (where deemed appropriate by your Trainer/Assessor), or appeal the result. If after this re-attempt, you are still unable to demonstrate the required level of knowledge and skills you will again be deemed Not Yet Satisfactory for the individual assessment task and will be found to be Not Yet Competent for the specific Unit/s of Competency in which the specific assessment task is required. If you are deemed Not Yet Competent your trainer / assessor will guide you on the re-assessment process which may include being offered the opportunity to re-sit through the theory component of the Unit of Competency where you have been found to be Not Yet Competent and then be given the opportunity to either re-attempt the entire original assessment task/s, add information to the original assessment/s (where deemed appropriate by your Trainer / Assessor). As part of the assessment process all students must abide by any relevant assessment policies as provided during the enrolment process and induction. Instructions to the Student Please read all the information given to you before you start any assessment task. If you do not understand some or all of the questions, please ask your Trainer / Assessor for assistance. If you are uncomfortable with any of these questions, please contact your assessor who will make alternative arrangements where appropriate. Attempt to answer ALL questions in your own words (unless otherwise directed) on the assessment paper provided. All assessments are intended to be equitable, fair and flexible. If you feel that we should change any aspect of any assessment to be fair, equitable or flexible, immediately contact your Trainer/Assessor who will attempt to make alternative arrangements for future assessments. Feedback and Review At the completion of each assessment task your trainer will correct your work and then discuss the correct answers to each question/criteria with the class giving an explanation on why each area of knowledge is important. This review will only occur once all students have completed their work to a satisfactory level to ensure that all aspects of assessment tasks completed are not done so with the help of this feedback/review. Plagiarism Plagiarism is a form of cheating. It is taking and using someone else’s thoughts or writings and representing them as your own. Plagiarism is a serious act and may result in a participant’s exclusion from a Unit of Competency or a course. This in turn may require for students to pay to re-complete the module or course at a later date. The following list outlines some of the activities for which a participant can be accused of plagiarism: 

Presenting any work by another individual as one’s own unintentionally



Handing in assessments markedly similar to or copied from another student



Presenting the work of another individual or group as their own work.



Handing up assessments without the adequate acknowledgement of sources used, including assessments taken totally or in part from the internet.

Many of the assessment tasks are ‘open book’ yet should still be conducted under test conditions without consultation with other students. If you are unsure of any assessment requirements you should check with your Trainer / Assessor.

Scenario - Leary Avenue, East Bentleigh You will need to refer to this scenario for Activity 1.1 – Plans and Activity 1.2 – Variations and client communications. John and Joan Smith have engaged your services for the construction of their house, a two storey dwelling on Leary Avenue in East Bentleigh. The contract documents have been signed and the site plans have been produced externally by a surveyor. For this scenario, you will need to refer to the following documentation: 

PART B What do I need to do? Referring to the PN33837 Leary Ave Plan Pack V2.0, locate the Buratt Structural Engineers Job Number 50085. You will then need to look at sheet 2 of 7 and provide a hand drawn ISOMERTIC PROJECTION SKETCH of the edge rebate detail. The sketch must include: 

Dimensions of slab edge beam and thickness of slab



Steel reinforcement Rib Bars, Trench mesh, Slab fabric, Waffle pods.



Draw in a recess for a shower base showing waste hole



All Aspects need to be labelled correctly with arrows pointing to the element



You must upload your sketch via either a photo or scanned copy.

The builder now charges a variation fee of $1,100 should a client request a variation to the signed contract. This fee is on top of the cost of materials, labour and the builder’s margin.



The builder and owner have agreed that the owner is to pay the cost of the cross-over if the owner has not already provided it or it needs to be relocated.

To be conservative, David has added another 5 days due to the nature of the building contract.



Construction time: the parties have agreed to 120 days of building.

Costs, Payments and Inclusions: 

The contract price is $320,000 plus GST and the parties have agreed to Progress Payment Method A, with the maximum allowable deposit being charged.



All service and facilities fees are included in the contract price and there are NO excluded service fees.



All fixtures and fittings are included in the contract.



As a Provisional Sum item, there has been an allowance made for 80 square meters for tiles and labour, allowing $130 psm – for both.



No materials or items of work to be supplied by the owner and there are no second-hand materials to be used.

Activity 1.3 - Prepare a contract PART A What do I need to do? You are now required to prepare the contract for construction for Trent’s new home and a cover page to provide all required information regarding the construction. You must refer to the scenario above for full details. Contract You are not required to use the BAA Constructions template provided and may use any template of your choosing as long as it meets the legal requirements for a building contract within your state or territory and is suitable for purpose. When preparing the contract, you must consider the following: 

Correct choice of contract type



Selection of appropriate clauses and conditions



Causes of a breach of contract specified



Requirements for offer and acceptance of contract specified



Requirements for termination of contract specified



Calculate prime cost “rise and fall” values for inclusion



Calculate provisional sum values for inclusion



Schedule for progress payments specified



Requirements for extension of time specified



Inclusion of all related documentation



Accurate reference to relevant legislation and regulatory requirements

Ensure the contract and cover page consider any cultural differences

Activity 1.4 - Prepare a checklist and dispute resolution procedure PART A What do I need to do? You have now completed the contract and have scheduled a meeting with Trent to review the clauses and formally sign the contract. Before your meeting, you are required to prepare a checklist of all of the matters that you need to address with Trent to ensure he has the capacity to enter into a legally binding contract and that he gives consent to the entering of a contract. Checklist When preparing the checklist, following must be covered: 

Evidence that capacity of the client to form a binding agreement will be confirmed prior to request to sign



Identification of factors associated with the ability to the client to give informed consent

Dispute Resolution Procedure You are also required to prepare a dispute resolution procedure and provide it to Trent so that he is aware of how any disputes arising during the construction process are to be managed. You must ensure that the dispute resolution procedure addresses: 

Activity 1.5 - Undertake an ABLIS report ABLIS is the Australian Business Licence and Information Service. It helps business operators and people considering starting a business identify relevant state, territory, local and Australian government licences, permits, approvals, regulations and codes of practice, allowing you to obtain detailed information and manage compliance obligations. New business operators can go to the site, answer a series of questions about their business, and in turn generate a report that gives them information on licenses, permits, approvals etc. related to their business operations. Please note that this information is not always sufficient to address all licences, permits and registrations required for the operation of a business. In some cases you will need to confirm with state regulators and licensing authorities. You will need to go to the ABLIS website (provided below) and generate a report related to your new business (or the business you wish to open in the future) to complete the following activity. Your new business will build a single storey residential project in the location you nominate. 

Activity 1.6 - Role Play Negotiations BAA Constructions Pty Ltd has signed and entered into an Enterprise Bargaining Agreement (EBA) with employees that is registered with the Fair Work Commission. Therefore, as the builder you are legally obligated to comply with the requirements of the EBA regarding the payment of salaries, allowances and entitlements to employees. You are employed with BAA Constructions Pty Ltd as a Project Manager responsible for the project no. 20361 which has an EBA on the project. The steel fixing sub-contractor has told you all his labour team are sub-contractors to his company and are paid on an agreed flat hourly rate. The sub-contractor further advises that the sub-contractors he engages do not have full time employment status under the Fair Work Act. The sub-contract Steel fixer provided you with an unconditional tender agreeing to all of the sub-contract conditions for the project. You must negotiate with the subcontractor to explain to them the agreed contract conditions and how he must comply.

PART A What do I need to do? This activity will be conducted on groups of two with each student taking turns to play the role of the business owner and financier. You must arrange a time with your assessor to complete this assessment. You are required to locate Section 50 of the Fair Work Act 2009 and determine the requirements regarding payment rates for sub-contractors. You will be required to take turns in playing the role of the Project Manager and Steel Fixer, see below for guide: ROLES Project Manager You are the Project Manager for this project and are responsible for all compliance requirements to be met. You are meeting with the Steel Fixer to discuss the issue of rates of payment for the sub-contractors. You must cover following information: 

Discuss how the current situation is going to be resolved to be in line with the above Act
