CALL TO ORDER The Board President, Dr. Scott Steingard, called the meeting to order at 8:07 a.m.

MOTION: Dr. Ward moved for finding of UNPROFESSIONAL CONDUCT, to include violations of A.R.S. §32-1854(6) and (38). The respondent fell below the standard of care, as noted as concerns in the Medical Consultant’s reports dated Feb 4, 2012 as well as June 29, 2010: • Prescribing excessive controlled substances to chronic pain patients • Pharmacy inquiries and drug screens were ignored in patients that were clearly diverting, and • Respondent failed to: o stop prescribing controlled substances for patients that had overdosed; o recognize drug seeking behavior in patients; o request prior medical records; o obtain appropriate laboratory testing; o conduct a physical exam in at least one patient; o obtain consultations; o follow the directions of specialists or recommendations when consultations were obtained. • The respondent fell below the standard of care by failing to conduct an adequate medical evaluation prior to initiating treatment with testosterone. The aforementioned behavior resulted in the respondent practicing medicine in a manner that harmed or had potential to harm patients and fell below the community standard as noted in the Medical Consultant’s reports, and further this conduct endangered a patient or the public’s health. MOTION: Dr. Ward moved for a Summary Suspension and referral to formal hearing for the purpose of Revocation. The motion was not seconded. The Board recessed to Executive Session at 2:42 pm for the purpose of obtaining legal advice and returned to Open Session at 2:49 pm. Dr. Ward withdrew his Motion. MOTION: Dr. Ward moved for: • a DECREE OF CENSURE, • Restriction from prescribing or recommending Schedule I, II, III and IV controlled substances for a period of 2 years, • Restriction from providing chronic pain management or supervising Physician Assistants until otherwise approved by the Board and • PROBATION for a period of 5 years to include the following terms: o a Board approved practice evaluation to be completed at the cost of the physician within 6 months, o thereafter a Board approved practice monitor at the cost of the physician to ensure that:  the physician is meeting all statutory requirements  obtaining adequate histories 7

 performing appropriate physical exams  obtaining appropriate laboratory testing and imaging  instituting the community standard of care  obtaining appropriate consultations and to report to the Board quarterly CIVIL PENALTY of $500 per each statutory violation to be paid within 90 days. The respondent will bear all costs associated with the terms of probation.

Asst. Attorney General’s report on Lynne Pirie, DO/Case No. DO-08-4058 Ms. Froedge informed the Board that the Superior Court upheld the revocation of license number 1878 issued to Lynne Pirie, DO.

C.

Letter from Leon Cattolico, DO. Dr. Cattolico has asked the Board to encourage use of the Prescription Monitoring Program.

D.

Consideration of committee to update pain management guidelines. The committee will be asked to convene and begin work as the new guidelines are out. 1

H.

ED Report on AIM and FSMB meetings (April 25-28, 2012) There was no discussion of the report.
