Goal

The goal of this policy is to encourage busking by providing a systematic repeatable process that offers support for the performers and promotes activities in the Great Lakes area. 2

Scope

This policy relates only to those busking activities on Council land, or on land under the care and control of Council. 3

Specific Objectives

3.1

To promote high quality creative improvements to the streetscape that will contribute to the vitality and cultural life in the Great Lakes area.

3.2

To establish criteria for the selection and approval of performers and busking activities, with the view to providing a benefit to the community as a whole.

3.3

To regulate procedures for the effective coordination of performers and busking activities within the Great Lakes area.

4.

Definitions

The following definitions apply for the purposes of this policy. All references to singular imply the plural and vice versa. 4.1

Busking: to perform entertainment live, in a public location, for offerings of money provided by those of the general public within the areas they see fit.

4.2

Dangerous materials and Implements: materials and implements that pose risk, hazard or uncertain outcomes for people. a) Dangerous materials include, but are not limited to corrosive materials, flammable materials and chemicals, fire, fireworks, smoke, flares, heated elements, or anything giving off a level of heat or toxicity that poses a threat of harm or damage to members of the public and/or public property. b) Dangerous implements include, but are not limited to knives, swords, spears, axes, spikes and other sharp objects of any kind that pose a threat of harm to the general public and/or damage to public property.

4.3

Performer/Busker: a person who provides performances, in public places, for monetary donations, for the entertainment of the public, ie a person who is busking.

4.4

Nuisance: use of public property or a course of conduct that may be vexatious, offensive, noxious or a bother to the community that unreasonably interferes with the health, safety, comfort, morals, reasonable general use of public property, and/or legal rights of others by causing damage, annoyance, inconvenience or disturbance to citizens in general.

4.5

Mobile Stage: a temporary platform, that is usually raised, on which busking performances are presented.

4.6

Personal Works: recordings of personal performance on video, DVD, CD or other relevant format.

4.7

Props: any movable articles, except costumes, which are used during a busking performance.

4.8

Key locations: specified sites, on Council land within the Great Lakes area where busking is permitted under the conditions defined with this and other relevant Council policies.

Procedure

5.1

All applications must be made in writing to Great Lakes Council and applications must provide a description of the proposed busking activity.

5.2

Applications will be dealt with in order of receipt.

Policy Details

6.1

Any person may apply in writing to Great Lakes council to busk within the Great Lakes area.

6.2

There is a busking licence fee for the general administration and insurance of standard applications, the busking licence will be valid for 12 months from the date of issue, and locations for busking are to be approved by Council a maximum of 12 weeks in advance of performance.

6.3

The relevant fees are outlined in Council's Schedule of Fees and Charges, and shall be amended from time to time, as Council deems necessary.

6.4

Buskers may only offer goods or merchandise of their own personal works for sale.

6.5

Council may request a busker to cease or relocate their activities at any time.

6.6

Buskers shall not interfere with or impede public thoroughfare, create a nuisance, deliberately taunt or defame any citizen.

6.7

Performers under 18 must provide a Parental Consent form with their application.

6.8

It is the responsibility of the holder of the busking licence to ensure the site in use is clean, undamaged and safe before, during and after performance and that any faults, damage or concerns are reported to Council in a timely manner.
