1. Why do we need this document? This document gives a detailed explanation of the process to be followed to comply with the mandatory document NP4 Management of Plant and legislation, whilst embracing and ensuring the safe operation of an excavator

To ensure compliance, plant must be sourced from a BAMLink Services Hire Desk or a BAMLink Services Partner as dictated within NP4.

2. This document must be read in conjunction with:

3. Every excavator operating on a BAM Nuttall managed site must be: • Compliant with current European Emission Standards and the NRMM Emissions Directive for use in Greater London, the Central Activity Zone & Canary Wharf. • Compliant with EC Machinery Directive 2006/42/EC and supplied with a declaration of conformity

• Compliant with BAM Nuttall’s policies for the management of HAVs Noise and Dust • Compliant with Management Bulletin MB239 Machine control These requirements will be managed using BAMLink Services and our BAMLink Partners

4. The Agent It is the agent’s responsibility to appoint a plant coordinator and a competent person ensuring that all personnel are adequately trained and competent in the operation of plant, equipment and fleet.

If planning a lifting operation with the excavator, the Agent must appoint an Appointed Person Lifting (APL)

The Agent ensures the completion of plant form PF602

The agent is responsible for ensuring all operators are supplied with information, instruction and training on the use of work equipment

5. The Plant Coordinator

Upon delivery to site the Plant Coordinator must ensure that: • Plant form PF602 is completed • The manufacturers handbook & operator’s instructions are with the machine • 12 monthly thorough examination certificates in date and available for inspection (Machines >=5T) I BAM Nuttall Management System NS4.1.0 I Version: 3.0 Revised: 27.07.2021 by B Green I Approved by S Jarvis - Page 3 of 14

• There is evidence of pre-hire inspection • There is evidence of regular inspection plus “next service and or inspection due” date sticker • All safety decals in place are legible • The item of plant is inspected by a competent person • Issue the operator with the correct pre-use inspection check sheets • Where an item of plant is not dedicated to one operative, the operator’s environment and controls must be sanitised prior to use

6. The Competent Person

The competent person must ensure that the machine is fit for use: • Protected cab (ROPS cab structure >=1.5t with glazed cab) • Live tracking system (>= 5t machines) • Quarry spec light to indicate seat belt worn • Seat belts must be fitted and operational • Seat to be suitable and sufficient for purpose and must be adjusted to suit the operator’s height and weight • Supplied with work lights and flashing amber beacon • Mirrors / CCTV to satisfy 1m high at 1m distance visibility criteria • High visibility cab steps and grab handles to ensure 3 points of contact is achievable • White noise reversing alarm • Locking doors with key. Locking caps/covers to fuel and all other tanks • Where it has been risk assessed that in the event of a fire an easy escape from the work equipment could not be achieved, a fire extinguisher must be carried in the cab I BAM Nuttall Management System NS4.1.0 I Version: 3.0 Revised: 27.07.2021 by B Green I Approved by S Jarvis - Page 4 of 14

• Isolation control by a secondary device • Where access is required at height for security & maintenance purposes, suitable handrails must be in place • Buckets to be supplied with teeth as default • If a wheeled machine - wheel nut indicators labelled each side with tyre inflation pressure

If lifting • 6 monthly thorough examination certificates on lifting accessories, • Have check valves fitted to excavator booms, dipper arm and depending on the position of the lifting point the crowd ram • Have acoustic or visual rated capacity indicators or limiters • Certified lifting points for all lifting duties • Safe load indicator or Rated Capacity indicator • SWL to be clearly marked • A machine specific lifting duty sheet, lift plan and risk assessment to be briefed and understood • Be trained in the use of specific lifting attachments • When using a lifting eye, a swivel hook must be used to ensure load can be manoeuvred without risk of swinging back or overloading • Must know the weights of the loads before lifting • Check valves fitted to boom and dipper circuits • Check valves fitted on bucket ram when forks are used • If used under overhead cables or obstructions, must be fitted with height restrictors and indication on machine

• The operator must hold a valid CPCS card for the excavator being utilised and must have been given sufficient time to undertake familiarisation training on the specific machine

If using a quick hitch and / or an attachment

Must be compliant with NS4.1.2 The safe use of quick hitches and attachments

7. Planning of the operation

All persons preparing risk assessments involving plant are encouraged to review previous risk assessments undertaken for similar activities and safety alerts Risks to be considered are: o If planning a lifting operation, the Appointed Person Lifting (APL) should firstly consider whether an excavator is the most appropriate machine, considering the type of lift, the duration of the task and the frequency o The environment in which it is to be used o How it is used o Overhead obstructions o Crushing risk in the slew zone o Overturning due to ground/site conditions particularly when a lifting operation is being carried out o Effect of weather on visibility and working/traffic surface o Use of accessories – e.g. breaker, o Operational exclusion zone o Public interface, consider slew restrictors I BAM Nuttall Management System NS4.1.0 I Version: 3.0 Revised: 27.07.2021 by B Green I Approved by S Jarvis - Page 6 of 14

The risks stated are meant as a guide only and are not exhaustive

8. The Operator (pre-work) • The operator must have attended a full induction prior to starting work and to have passed D&A test on induction (NP3.2) and be subject to ongoing medical screening/surveillance • Be briefed on any site-specific work activity risk assessment and check for overhead obstructions and hazards • The operator must hold a valid CPCS card for the excavator being utilised and must have been given sufficient time to undertake familiarisation training on the specific machine o A10 Excavator 180º below 5 tonnes o A12 Excavator 180º above 5 tonnes o A58A Tracked Excavator 360º below 10t o A58B Wheeled Excavator 360º below 10t o A59A Tracked Excavator 360º above 10t o A59B Wheeled Excavator 360º above 10t CPCS cards for an excavator being used as a crane are: o A58C Excavator below 10 tonnes – Lifting Operation o A59C Excavator above 10 tonnes – Lifting Operation familiarisation training and the techniques used can vary and may include (as appropriate to the risk, complexity of the task, equipment and existing competence of staff): o Self-study o In house training and demonstration with supervision

o Formal in-house training, provided by competent, qualified or experienced staff often coupled with some form of documented competence assessment o externally provided training (usually with a competence assessment), provided by competent, suitably qualified people • Be signed onto the appropriate Safe System of Work documentation for the task in hand • Full site-defined PPE must be worn – no-loose fitting clothes as controls can be caught inadvertently • Have a competency assessment prior to being put to work – be familiar with machine • Be confident to report all unsafe conditions • Abide by specific Company policies, procedures and permits • Always operate/use the equipment in accordance with manufacturer’s instructions / recommendations • Be competent in undertaking pre-use inspections

9. Completion of Pre-use Check Sheets

The completion of a pre-use inspection is a legal requirement.

A pre-use inspection must be performed before the machine is used, by every operator; including on change of operator or shift.

An operator must be able to prove that they have completed the inspection and that the required items have been checked.

A plant check sheet ensures that: o the requirements of the pre-use inspection have been met o that the item of plant is fit for purpose and will not create any additional hazards during its use.

If the machine is unused, an inspection must be carried out at least every 7 days. Consideration should also be given to the working environment; if the conditions are more arduous than normal, for example in coastal locations, tunnels or cold weather, then the inspection regime should be increased. The term ‘inspection’ is defined by the Provision and Use of Work Equipment Regulations 1998 (PUWER) as a visual or more rigorous inspection by a competent person.

The purpose of an inspection is to identify whether the equipment can be operated, adjusted and maintained safely and that any deterioration (for example, any defect, damage or wear) can be detected and remedied before it results in a hazard.

A safety critical fault is when an item is in a condition that if operated may cause an injury or ill health. A safety critical fault must be reported to the supervisor or plant coordinator immediately and the machine quarantined until it is rectified the hire-company.

The supervisor or plant coordinator may decide that it is necessary to move the machine to prevent another hazard. This can only be done on consultation with the or hire-company and the production of a risk assessment. Other faults, or nonconformance recorded on the pre-use inspection must be reported to the supervisor or plant coordinator as soon as possible.

The pre-use inspection check sheets must be held on record along with any other maintenance documentation for the machine and when a fault is identified a copy must be sent to the or hire-company.

An electronic version of the pre-use check sheet may be used if it meets or exceeds the criteria of the relevant check sheet.

The operator (work) • Complete the approved pre-use check sheet for the machine in use or an equivalent approved e-inspection format • Comply with the inspection and defect reporting system • Ensure that buckets are carried safely at all times • All hoses to be inspected regularly (pre-use) • Operator to mount and dismount machine using fixed access arrangements and always facing the machine using 3 points of contact • Seat belt must be worn • Engine must be turned off if approached by others and keys removed from the ignition before leaving the cab unattended for any reason • Shall stop work if any unauthorised/unsupervised personnel enter their immediate work area

• Operator must not lean out of seat to view excavation • Axle locks to be to be used for wheeled duties • Stabilisers must be deployed when excavation duties are being conducted

When using the excavator on the public highway • Compliant with Construction & Use Regulations e.g. lights, indicators, registration plate’s front & rear etc. • Vehicle Excise Duty (VED) registered with the correct fuel used dependant on the taxation class • Registered on the motor insurance database • The operator must be compliant with NS4.5 Authority to Drive • The operator must hold the correct category of driving licence for the item of plant being utilised • The operator’s driving licence category entitlement must be checked by their line manager to ensure that it covers the Item of plant that the operator is being asked to drive. • The fitment of conspicuity markings on the rear of vehicles, plant and any towed trailer is mandatory • Tooth Guard must be used when traveling on the public highway • Completion of Plant and Fleet Form PF902 Plant being used on the public highway – Permit to operate • PC14 The use of plant on the public highway, must also be completed pre-use as an additional check sheet to that of the main machine.

• Do not use if equipment is, or appears to be damaged • Not to be used for lifting operations if operator does not have correct category CPCS qualification or machine documentation is incomplete or has expired • No entry into exclusion zone unless signalled by operator • Dot use Zero Tail swing models on excessive slopes

Additional options • Secondary control activation device • Telematics system c/w geo fencing • In cab quick hitch alarm • Zero Tail swing ballast/counterweight • Travel movement alarm • Capability to refuel at ground level

14.

Briefing

A daily briefing of all those involved in operations involving the use of excavators and supporting plant is essential and the briefing should encourage feedback of perceived issues
