RECORD NO.: 9383-18619 & 9678-19212 Dear Ms. Miller: Based upon an investigation and/or your admission, the Center for Student Conduct and Community Standards has determined in Case #9383-18619 that on or around December 11, 2009, you participated in a disturbance of the peace at University House in which you possessed a lit torch. As a result of this incident individuals felt threatened and in fear for their safety. Based on these facts, this office has determined that you should be charged with the following violation(s) of the Berkeley Campus Code of Student Conduct (“Code”): V.102.08. Physical abuse including but not limited to… and other physical assault; threats of violence; or other conduct that threatens the health or safety of any person. V.102.15. Participation in a disturbance of the peace or unlawful assembly. (See Berkeley Campus Regulations Implementing University Policies for further information). V.102.19. Possession, use, storage or manufacture of explosives, firebombs, or other destructive devices. Based upon an investigation and/or your admission, the Center for Student Conduct and Community Standards has determined in Case #9678-19212 that on or around February 17, 2010, you failed to comply with the conditions of your interim suspension by attending a forum on the student conduct process at the Valley Life Sciences Building. Based on these facts, this office has determined that you should be charged with the following violation(s) of the Berkeley Campus Code of Student Conduct (“Code”): V.102.16. Failure to identify oneself to, or comply with the directions of, a University official or other public official acting in the performance of his or her duties while on University property or at official
Page 2 of 3 University functions; or resisting or obstructing such University or other public officials in the performance of the attempt to perform their duties. V.102.21. Violation of the conditions contained in the terms of a disciplinary action imposed under this Code or campus regulations. Accordingly, this office proposes the following sanctions and conditions in resolution of your case: SUSPENSION
Due: 5/1/2011
Your student status at UC Berkeley and with all UC Berkeley affiliated programs, including “UC Extension”, will be terminated from May 17, 2010 to May 1, 2011, with reinstatement thereafter certain (provided that you have complied with all conditions imposed as part of the suspension and provided that you are otherwise qualified for reinstatement). Please note that violations of the conditions of Suspension or of University policies or campus regulations during the period of Suspension may be cause for further disciplinary action, normally in the form of Dismissal. During the period of Suspension, a notation of this disciplinary suspension will appear on your academic transcript. Upon completion of the Suspension, the notation of the disciplinary suspension will be lifted from your academic transcript. PLEASE NOTE: All future Registration will be canceled during the period of suspension. Be advised that it is your responsibility to contact your college regarding your readmission and to follow their policies and deadlines.
REFLECTIVE WRITING ASSIGNMENT
Due: 11/1/2010
You agree to write a "Reflection Paper" in accordance with the attached guidelines. The paper must be a minimum of twelve (12) pages, typed, and double-spaced. This paper must be completed and submitted for approval to Student Conduct by November 1, 2010. Please be advised that you are free to either enter into this Agreement with the University based on the sanctions proposed above, or have the matter fully adjudicated at a hearing. If you agree to this Administrative Disposition, you acknowledge your understanding that failure to comply fully with all sanctions and conditions stated above and within agreed upon timelines, will result in your registration being blocked and/or you being dropped from the rolls of registered students. Further, please be advised that the failure to complete disciplinary sanctions in a timely manner may itself be the basis for additional disciplinary action/proceedings (CSC, Section V.102.21). Should you agree to the proposed Administrative Disposition set forth above, please sign your name in the space provided below and return the signed original to Student Conduct within five business days. If you do not agree to this proposal, please so indicate in writing to Student Conduct within the same time period. At that point, Student Conduct will take steps to schedule a conduct hearing in this matter. IN THE EVENT THAT THE MATTER PROCEEDS TO SUCH A HEARING, PLEASE BE ADVISED THAT THE UNIVERSITY SHALL NOT BE LIMITED TO ASKING FOR THE SANCTION(S) AND/OR CONDITION(S) PROPOSED IN THIS AGREEMENT.
