Landowner Conditions 1.
To construct the driveway entrance at permitted location in accordance with all Town statutes, all provisions of Driveway Permit and Driveway Permit specifications issued by the Town of Guilderland Highway Department.
2.
To hold harmless the Town of Guilderland and its' duly appointed agents and employees against any action for personal injury and/or property damage sustained by reason of the exercise of the Town Driveway Permit.
3.
To furnish and install drainage structures that are necessary to maintain existing highway drainage and adequately handle increased runoff resulting from development and so that no drainage runs onto the Town roadway. To leave the highway right-of-way of the Town of Guilderland free from all debris such as stones, earth and brush resulting from the construction of such driveway.

The owner agrees to maintain the driveway culvert in good and operating conditions, regardless of the culvert location.
6.
Driveway Permits are non-transferable and are valid for only one year from date of approval.
7.
Property owner's agent must submit written proof that he or she is an authorized agent.
8.
An Insurance Certificate naming the Town of Guilderland as additional insured, in the amount specified in Insurance requirements must be provided. SIGNED:

Driveway Permit Application Instruction Sheet Commercial or Industrial Driveway Permit Application Instructions 1. Permits issued for commercial or industrial driveways must be accompanied by site plans drawn to scale with additional details showing curb radii, drainage, site distance and other construction features.
Residential Driveway Permit Application Instructions 1.
Flag driveway centerline (for recognition by the Highway Department - stakes with surveying ribbons, paint on the roadway, or similar techniques are acceptable.
2.
Complete the information required on the map (map not to scale) a.
Label North (N) on the compass.
b.
Label the distances from centerline of the proposed driveway to both property lines.
c.
Label the road name.
d.
Label the width of the proposed driveway.
e.
Label the width of the proposed driveway at the road.
f.
Label the approximate sight distance.
g.
Indicate proposed type of driveway surface.
h.
Label, by use of an arrow, the direction of drainage in the roadside ditch.
i.
Indicate the proposed type of headwall material to be used at each end of the culvert.
j.
Label the proposed diameter of the culvert to be used.
k.
Label the proposed depth of the culvert to be installed.
l.
label the proposed culvert construction: corrugated metal, reinforced concrete or HDPE

List any other information which may be of help to the Highway Department.
Submit application and attached map to the Town of Guilderland Highway Department for approval.
Once the Driveway Permit Application has been approved by the Superintendent of Highways, a Driveway Permit will be issued and: 1.
Before construction begins it is the owners responsibility to call Dig Safely New York and have the area flagged for underground utilities. Dig Safely New York 1-800-962-7962.

The applicant may construct the driveway as required. Once the driveway has been constructed, phone the Town of Guilderland Highway Department to arrange for an inspection and approval of the constructed driveway. (NOTE: a Certificate of Occupancy will not be issued without this final approval by the Highway Department.

Conditions for Construction 1.
All newly installed curb cuts (driveways) shall meet the most current AASHTO standards for minimum sight distance requirements.
2.
Normally only one driveway shall be permitted for each residential property. An additional driveway may be permitted by the Highway Department if both sufficient frontage exists and extenuating circumstances justify a second driveway.
3.
Driveway width shall range from 9 ft to 24 ft for driveways 50 ft or less in length and 9 ft to 12 ft for driveways longer than 50 ft. in length.
4.
Where required, driveway culverts shall be a minimum of twelve inches (12") in diameter and twenty feet (20') long; and must be constructed of either corrugated metal, reinforced concrete or HDPE . Culverts made of aluminum shall not be acceptable.

Headwalls constructed of stone or similar material shall be installed at both ends of all culverts. All driveway headwalls shall be constructed to the same elevation as the driveway. The width shall be determined by the depth of the culvert.
6.
The driveway shall be constructed to slope away from the edge of the paved roadway at a slope of 2% to 6% (.25 in/ft to 0.75 in/)ft to the low point of the driveway. As close to the center of the ditchline as possible.
7.
The maximum grade away from the driveways low point is 8% (1 inch per foot) in urban areas or 12% (1.5 inches per foot) in rural areas.
8.
All driveways shall intersect the Town's roadway at a perpendicular angle to the center line of each.
9.
Any construction carried out without a permit or not in conformance with this policy is subject to removal at the owners expense. Additional Conditions;

Insurance Requirements 1.
Said permittee shall be responsible for all damages resulting in bodily injury including death and/or property damage due to activities of the permittee, its contractors, subcontractors or either or both, agents or employees in connection with any act or omission hereunder; and does hereby expressly agree to indemnify and save harmless the Town of Guilderland and the Town Superintendent of Highways of said Town and his representatives and employees from claims, suites, actions, damages and costs or every name and description arising out of or resulting from any act or omission hereunder.

The Town Superintendent of Highways, before the permittee shall proceed with any work under this permit, will obtain on behalf of permittee a policy of protective liability insurance to and covering the liability of the Town of Guilderland and/or Todd S. Gifford as Superintendent of Highways of the Town of Guilderland, New York, with respect to all operations under this permit, by the permittee or by anyone acting by, through or for the permittee, including omissions and supervisory acts of the said Town Superintendent of Highways. The limits of coverage in such protective liability insurance policy shall not be less than $300,000.00 for all damages arising out of bodily injury including death for each person in any one accident, and not less than $500,000.00 for all damages arising out of bodily injury including death at any time resulting therefrom, sustained by two or more persons in any one accident, and not less than $50,000.00 for all deamages arising out of injury to or the destruction of property in any one accident, and subject to that limit for not less than $100,000.00 for all damages arising out of the injury to or destruction of property during the policy period. The permittee has to file with the Town Clerk a Certificate of insurance as listed or shown in the above paragraph.
3.
The enumeration in this permit of the kind and amount of insurance shall not abridge, diminish or affect the permittee's legal responsibility for the consequence of accidents arising out of or resulting from the operation of the permittee under this permit.
4.
Upon request of the Town Superintendent, the permittee will furnish him with proof that permittee has secured compensation for the benefit of and will keep insurance during the performance of the above described work such employees as are required to be insured by the provisions of the Workman's Compensation Law. If permittee has work performed by an independent contractor, such contractor shall furnish proof that such contractor has secured such compensation.
